Korea Housing Subscription Re-Winning Restriction Calculator — 10 Years for Price-Capped or Speculation-District Homes, 7 for Overheated Areas, 5 for 85㎡ or Less in Crowded Zones

Win a Korean housing subscription (cheongyak) once and you hear you “can’t apply for years”. That is the re-winning restriction in Article 54 of the Rules on Housing Supply, and it isn’t one number. A price-capped home or one supplied in a speculation overheated district means 10 years; a subscription overheated area means 7 years; a land-lease home 5 years; homes such as relocated-agency special supply or convertible public rental run from 5 years (85㎡ or less, overcrowding control zone) down to 1 year (over 85㎡, elsewhere). Enter the win date and the kind of home to get the period and its end.

1. Price cap or speculation district 10 years, overheated area 7, land-lease home 5 (Art. 54(2)1–3).
2. If more than one applies, the longest — a price-capped home in an overheated area means 10.
3. The whole household is caught, but private homes outside speculation and overheated areas can still be won during the restriction.

Updates as you type. Where more than one period applies, the longest is used (Art. 54(2)). The end date is our sum: counting the win date as day one, the restriction runs to the day before the same date N years later. Area and overcrowding-zone choices only matter for the third kind of home.

Para. 2 item 3Item 5 (land-lease) and redevelopment members’ homes in a speculation district: 5 years—
Para. 2 item 4Items 2, 4 etc. at 85㎡ or less: overcrowding control zone 5 years, elsewhere 3Zone under the Seoul Metropolitan Area Readjustment Planning Act Art. 6(1)
Para. 2 item 5The same at over 85㎡: zone 3 years, elsewhere 1—

Every period runs “from the win date”, not the contract or move-in date. What is blocked is being “selected as a resident” of another sale home; the article doesn’t bar applying as such. But the subscription agency searches winner lists and tells the developer of anyone inside a restriction (para. 3), and the developer must drop them from selection or cancel the contract (para. 4). So an application during the period ends up removed (our reading).

Five sums — our example

End dates are our sum. The rule only says “10 years from the win date” with no day-count method, so we count the win date as day one and end on the day before the same date ten years on. If a single day matters, check your record on Cheongyak Home.

Why the “household” matters

Paragraph 1 restricts everyone in the winner’s household, not just the winner. A spouse or child in the same household applying separately can’t be selected during the period. One exception is written in: for winners under Art. 47-3, only the applicant and spouse. Whether splitting the household avoids it turns on the household definition and timing, which we don’t judge here.

Two things get mixed up with this. One is the limit on special supply (Art. 55) — special supply is in principle given once, on a one-home-per-household basis. The other is the ban after an ineligible win is cancelled (Art. 58) — much shorter, from 1 year in the capital region, and a different thing.

The ban after a cancelled ineligible win is in ineligible winner ban calculator.

Checklist

  • ☐ Was the home price-capped (stated in the notice)?
  • ☐ Was the area a speculation or overheated area when you won?
  • ☐ More than one: take the longest
  • ☐ Everyone in the household is covered
  • ☐ Non-regulated private homes remain open

Questions that remain

Does giving up the win or not signing remove it?

Article 54 is written around “a person who won” and doesn’t make the contract a condition. We didn’t read the other articles on giving up, so check your record on Cheongyak Home.

What if the area is later de-designated?

The article asks whether the home was “supplied in a speculation overheated district”. Whether lifting the designation shortens a running restriction is not stated.
