Labour Standards Act Article 54 requires a break of at least 30 minutes for 4 hours of work and at least 1 hour for 8 hours, given during working time, which the worker may use freely. It applies to workplaces with four or fewer workers too (Decree Annex 1). An amendment of 9 June 2026 adds a proviso from 10 December 2026: where working time is 4 hours and the worker explicitly asks not to take the break, it need not be given. Enter the hours and the date and the checker tells you the minimum break.
1. 4 hours → at least 30 minutes; 8 hours → at least 1 hour; during working time (Art. 54(1)).
2. Applies to workplaces of 4 or fewer — Art. 54 is in Decree Annex 1.
3. From 10 December 2026: a 4-hour shift can go without a break if the worker explicitly asks — not if the employer drops it.
Checker
Updates as you type. The Act sets only two thresholds: 30 minutes at 4 hours and 1 hour at 8 hours. The proviso added on 9 June 2026 (in force 10 December 2026) is applied to the whole 30-minute band (our reading).
Article 54 — now and from 10 December
| When | Text | Worth noting (ours) |
|---|---|---|
| Until 9 December 2026 (current) | (1) The employer shall give a break of at least 30 minutes where working time is 4 hours, and at least 1 hour where it is 8 hours, during working time. (2) Workers may use break time freely. | No proviso |
| From 10 December 2026 | (1) Same, provided that this does not apply where working time is 4 hours and the worker has explicitly requested not to use the break. <Amended 9 June 2026> (2) Same. | The request must come from the worker |
The law database shows both texts side by side, the amended one marked “[Effective: 10 Dec 2026]”. So the checker applies the proviso only for dates from 10 December.
The proviso says “where working time is 4 hours”, the same words the main text uses for the 30-minute threshold, so the checker applies it across the 30-minute band, 4 to under 8 hours. That’s our reading; check the Ministry of Employment and Labor’s interpretation for, say, a 6-hour shift. There is no proviso for the 1-hour break at 8 hours or more.
Four checks — our example
| Case (our example) | Result | Worth noting (ours) |
|---|---|---|
| 9 to 6, 1-hour lunch (8 hours worked) | Meets it | 8 hours → 1 hour |
| 4-hour morning shift, no break, November 2026 | Short by 30 minutes | Before the proviso |
| Same shift on 15 December 2026, the worker explicitly asks to skip the break | Meets it | Proviso applies |
| 10-hour shift, 1-hour break just before leaving | Short | Not “during” work |
The Act sets only the 4-hour and 8-hour thresholds. Even for 12 hours the statutory minimum is 1 hour; anything more is for the contract or work rules. Shifts under 4 hours have no set break.
Breaks come out of working time under Article 50, and supervised waiting time counts as work, not a break (Art. 50(3)). The day’s pay is in overtime and night-work pay calculator.
Penalty — Article 110
Breaching Article 54 carries up to 2 years’ imprisonment or a fine of up to 20 million won (Art. 110 item 1). Article 110 also shows a text in force from 8 December 2026; both versions include Article 54.
Checklist
- ☐ Hours worked, breaks out, past 4 or 8?
- ☐ Is the break during the shift?
- ☐ Can you leave your post freely then?
- ☐ After 10 December, for a 4-hour shift: did the request to skip come from the worker?
Questions that remain
Can the break be split up?
Article 54 sets the total and “during”, not how it’s divided.
What if I must answer the phone on my break?
Paragraph (2) says break time is free, and Article 50(3) counts supervised waiting time as work. Whether you are really free reads as the test (our gloss).
