Duties While Receiving Korea's Basic Pension — Report Within 30 Days, Overpayments Recovered, Object Within 90 Days, 5-Year Prescription

Korea's Basic Pension comes with duties after payments start. Fail to report a move abroad, a long stay overseas or a change in assets and an administrative fine follows; money paid in error must be returned. In the other direction, a decision you cannot accept can be challenged. We read Articles 16 to 23 and 31 of the Basic Pension Act in the original.

1. Report changes within 30 days. Failing to report without a justifiable reason carries an administrative fine of up to 100,000 won (Articles 18 and 31(2)).
2. Basic Pension paid in error is recovered. Where it was obtained by false or other wrongful means, interest is added (Article 19).
3. An objection must be filed within 90 days of learning of the disposition. In writing, to the head of the city, county or district (Article 22).

Suspension and loss are different — Articles 16 and 17

"Resumes" and "the right itself ends" are our gloss. For a stay abroad, the day it reaches 60 days is treated as the day the ground arose (Article 16(1)(3)). The four suspension grounds are also set out in the Basic Pension guide. "No longer qualifying" appears to cover cases such as recognised income rising above the selection threshold (our reading — the requirements of Article 3).

Five things to report within 30 days — Article 18

  • A ground for suspension has ended (for example, returning to Korea)
  • A ground for loss of entitlement exists
  • A change in income or assets of the recipient or spouse meeting the standard set by Presidential Decree
  • The recipient marries or divorces, or the spouse dies
  • Other grounds prescribed by Ministry of Health and Welfare ordinance

The report goes to the head of the special self-governing city or province, city, county or district. Where the recipient has died, the person obliged to report under the family relations registration Act must report, and filing the death report is treated as making this report (proviso to Article 18(1); Article 18(2)).

"Returning to Korea" is our example. How large a change in income or assets must be reported (the Decree standard) and the grounds set by ordinance were not read this time. Marriage, divorce and a spouse's death appear to be reportable because the thresholds and amounts differ between single and couple households (our reading).

If you do not report

  • Failing to make the Article 18 report without a justifiable reason — an administrative fine of up to 100,000 won (Article 31(2))
  • Failing to submit income or asset material, submitting false material, or refusing an inquiry without a justifiable reason — an administrative fine of up to 200,000 won (Article 31(1))
  • Receiving the Basic Pension by false or other wrongful means — imprisonment of up to 1 year or a fine of up to 10 million won (Article 29(3))

  • Where Basic Pension is still to be paid, it may be set off against the amount to be recovered (Article 19(2)) — that is, deducted from later payments (our gloss).
  • Recovery may be waived where the amount is below the figure set by Presidential Decree (Article 19(3)).
  • The procedure runs: payment notice → demand → collection in the manner of local tax arrears (Article 20).

The interest rate and the waiver threshold are in the Decree, which we did not read. The right to the Basic Pension and money received as Basic Pension cannot be seized (Article 21), but set-off against a recovery is separately permitted by the Act — protection from seizure is covered in protecting a pension from seizure.

Objection — Article 22

A person who objects to a Basic Pension decision (Article 13) or another disposition under the Act may file an objection with the head of the special self-governing city or province, city, county or district. It must be made in writing within 90 days of learning of the disposition; where you prove that a justifiable reason prevented this, it may be made within 60 days of that reason ending.

The right-hand column is Article 108 of the National Pension Act as read in challenging a National Pension decision. Article 22 of the Basic Pension Act has no sentence corresponding to "180 days from the date of the disposition". If you learned of the disposition on 7 October 2026, 90 days falls around 5 January 2027 (our simple addition — we did not read the rules on computing periods). The objection procedure and the period for notifying a decision are in the ministry's ordinance, which we did not read.

Prescription is 5 years — Article 23

The right to recover and the rights of a person entitled to the Basic Pension both lapse by prescription if not exercised for 5 years. The same period runs both ways — the local government's right to get money back and the recipient's right to be paid.

Article 19 also lists "where the Basic Pension was paid in error for other reasons" — it does not require intent (our reading). Intent matters for the interest and the criminal penalty.
